General Terms and Conditions (GTC)

§ 1 Scope and Contract Language

1. These General Terms and Conditions (GTC) apply to contracts concluded between you and us, GW Premium ABRAZIVE SRL, represented by the managing director Mr. Dorel Arsenie, Str. Marasesti Nr 25E, Tisauti, Judeta Suceaca, (Click: Imprint) via this online shop.
2. The language available for concluding the contract is exclusively Romanian. Translations of these General Terms and Conditions into other languages are provided only for your information. In the event of discrepancies between the language versions, the Romanian text shall prevail.

§ 2 Applicable Law, Mandatory Consumer Protection Regulations

1. The law of the country Romania applies, excluding the UN Sales Law, if
   1. you have your habitual residence in Romania, or
   2. your habitual residence is in a state that is not a member of the European Union.
2. In the event that you have your habitual residence in a member state of the European Union, Romanian law also applies, without prejudice to the mandatory provisions of the state in which you have your habitual residence.

§ 3 Formation of the Contract

1. The presentation of goods and services in our online shop does not constitute a legally binding offer, but an invitation to place an order.
2. By clicking the button labeled “Order with obligation to pay” in the final step of the ordering process, you submit a binding offer to purchase the goods displayed in the order overview.
3. Immediately after sending the order, you will receive an order confirmation, which does not yet constitute acceptance of your contractual offer. A contract between you and GW Premium ABRAZIVE SRL is concluded as soon as we accept your order by a separate email or dispatch the goods.
4. Please regularly check the SPAM folder of your email inbox.

§ 4 Technical Steps Leading to Contract Conclusion and Correction of Input Errors

1. During the ordering process, you first place the desired goods in the shopping cart. There, you can change the desired quantity or completely remove selected goods at any time.
2. If you have placed goods there, by clicking on the “Continue” buttons, you first reach a page where you enter your data and then select the shipping and payment method.
3. Finally, a summary page opens where you can review your entries. You can make changes to your entries (e.g., changes regarding payment method, data, or desired quantity) by clicking on “Edit” at the respective field.
4. If you wish to completely cancel the ordering process, you can simply close your browser window. Otherwise, after clicking the confirmation button “Order with obligation to pay”, your declaration becomes binding in terms of § 3 Para. 2 of these GTC.

§ 5 Storage of the Contract Text

1. The contract provisions with details of the ordered goods including these General Terms and Conditions and the cancellation policy will be sent to you by email upon acceptance of the contract offer or with the notification thereof.
2. We do not store the contract provisions.

§ 6 Registration in Our Online Shop; Processing of Your Personal Data

1. You can order goods in our online shop as a guest or as a registered user.
2. As a registered user, you do not need to enter your personal data such as name and address every time but can simply log in to your customer account with your email address and the password you chose during registration before or during an order.
3. Registration alone does not entail any purchase obligation regarding the goods offered by us.
4. For information on the processing of your data, please read our privacy policy, which you can access via the following link: https://premiumabrazive.ro/. By registering, you choose a personal username and password.

§ 7 Payment Terms and Prices

1. The purchase price is due immediately upon ordering.
2. Payment for the goods is made via the payment service provider Netopia Payments. (Credit card: VISA and Mastercard, Bank transfer) Cash on delivery is also possible.

We use the “SSL” transmission procedure to encrypt your personal data. (Click: Privacy Policy)

3. In the case of credit card purchases, your credit card account will be charged upon dispatch of the order by us.
4. The prices listed at the time of the order in the offer apply. The indicated prices are final prices, i.e., they include the applicable statutory value-added tax and are exclusive of shipping costs. Depending on the shipping method, the shipping costs are calculated based on size, weight, and the number of packages.
5. You agree to receive invoices and credits exclusively in electronic form.
6. Please note that we only accept payments from accounts within the European Union (EU). Any costs of a money transaction are to be borne by you.
7. Deliveries can only occur within Romania.
8. Shipping for orders over 500 Lei is free of charge.

§ 8 Delivery and Payment

1. Payment by Payment Order

This is done exclusively based on the invoice issued by GW Premium ABRAZIVE SRL and after telephone confirmation of the order by a sales consultant. The delivery of the goods occurs after the payment has been confirmed on the account specified in the issued invoice. For legal entities, the representative or authorized person must present a signed power of attorney with the company seal to take possession of the package.

2. Payment by Cash on Delivery (or Refund)

If goods are purchased by cash on delivery, you have the option of delivery by cash on delivery or direct payment upon receipt of the goods. The purchase price is paid in cash to the courier, along with the shipping value according to the invoice, which is always located in the shipping envelope of the main package of the order on the back of the shipping document.

Should the buyer be absent on the day of delivery, the courier will contact the buyer to arrange a new appointment. The buyer must contact the delivery agent at the delivery address within 5 days of the courier’s first notification to take possession of the products. After this 5-day period, the products will automatically be returned to the sender by the courier.

3. Payment by Card

  • You agree that the provision of services or products begins immediately after the completion of all necessary registration formalities.
  • The information provided must be correct. By deciding to register, you agree to provide us with your correct name, address, and other mandatory useful information.
  • By accessing your account and using your personal password, you are responsible for all actions resulting from their use. The company GW Premium ABRAZIVE SRL cannot be held liable for errors due to the user’s negligence regarding the security and confidentiality of their account and password.
• Security of Personal Data
  • Your personal data may be used by GW Premium ABRAZIVE SRL to confirm orders, inform by email, post, or other means of communication about subsequent actions, create statistical reports, etc.
  • Your personal data may be transferred to law enforcement authorities for the purpose of verifying commercial transactions or to other law enforcement authorities for conducting legally justified inspections.
  • The data provided by customers are treated with strict confidentiality. GW Premium ABRAZIVE SRL commits to its customers not to disclose this data to third parties or companies and to use it exclusively for the business relationship between the customer and GW Premium ABRAZIVE SRL.
  • This website uses security measures against the loss, alteration, or misuse of information under our control.
  • GW Premium ABRAZIVE SRL commits to respecting your rights granted by Law 677/2001 and, upon your request sent to service@premiumabrazive.ro, to stop processing your personal data or to correct, update, block, delete or convert into anonymous data the data whose processing does not comply with the provisions of Law No. 677/2001 concerning the protection of individuals with regard to the processing of personal data and the free movement of such data.
  • GW Premium ABRAZIVE SRL ensures that it complies with the provisions of Law No. 677/2001 on the protection of individuals with regard to the processing of personal data and the free movement of such data, Law No. 365/2002 on electronic commerce, as well as Regulation No. 130/2000 on consumer protection in the conclusion and execution of distance contracts with subsequent amendments. These rights include (the list is not exhaustive):
  • the right to request from GW Premium ABRAZIVE SRL, free of charge for one request per year, a confirmation as to whether your personal data are being processed or not;
  • the right to request from GW Premium ABRAZIVE SRL the free correction, updating, blocking, or deletion of data provided whose processing does not comply with the provisions of Law No. 677/2001;
  • the right to request from GW Premium ABRAZIVE SRL that the processing of your personal data be stopped free of charge;
• For online payments, the payment of services on this website is made through the online payment solutions offered by Netopia Payments.

To exclude the risk that your data might be captured and misused by third parties:

• GW Premium ABRAZIVE SRL and Netopia Payments guarantee the security of the IT systems used.
• Information on bank card data (card number, expiration date, etc.) is not transmitted or stored at any time on the servers of GW Premium ABRAZIVE SRL or Netopia.
• In the case of the 3D-Secure system for payments with Visa or MasterCard cards, the data of your card are entered directly into the systems of Visa or MasterCard, and if your card was issued by a bank certified in the 3D-Secure system, the authorization of the transaction is carried out only after your authentication in this system by entering a secret code/password known only to you, similar to the PIN code for ATM transactions.
• Any attempt to access the personal data of another user or to alter the content of the website ” https://premiumabrazive.ro ” or to impair the performance
•  of the server on which the website https://premiumabrazive.ro runs, will be viewed as an attempt at fraud of the website https://premiumabrazive.ro and will result in a criminal investigation against those who attempted this fraud.

4. Partial Delivery

It may happen that certain ordered products are no longer in stock and this aspect cannot be corrected in real-time on https://premiumabrazive.ro/. In these cases, only the products available for shipment to the buyer are billed without prior notification, and the package is shipped accordingly. In these situations, the buyer is contacted to inform them of this aspect and to ship the available products.

Check the condition of the product upon receipt of the package! If you notice any damage, document this incident together with the representative of the courier company (courier).

5. Price Information

The prices displayed on https://premiumabrazive.ro/ are net prices.

6. Shipping Costs

The sold products are delivered by express courier to the destination specified by the customer. The products displayed on the website https://premiumabrazive.ro/ do not include transport tax.

For some products, we reserve the right to offer free shipping depending on the quantity, delivery time, weight, distance.

Within Romania, there are no shipping costs if the total order exceeds 500 Lei. The mentioned prices for transport apply exclusively in the locations of the courier network.

§ 9 Reservation of Ownership

The goods remain our property until full payment is made.

§ 10 Delivery Conditions

1. We deliver the goods according to the agreements made with you.
2. Incurred shipping costs are listed in the product description and are separately indicated by us on the invoice.

§ 11 Limitation of Liability

1. We are liable for intent and gross negligence.
2. Furthermore, we are liable for the negligent breach of duties whose fulfillment makes the proper execution of the contract possible in the first place, whose breach endangers the achievement of the contract purpose, and on whose observance you as a customer may regularly rely. In the latter case, however, we are only liable for the foreseeable, contract-typical damage. The same applies to breaches of duty by our vicarious agents.

§ 12 Jurisdiction; Online Dispute Resolution; Severability Clause

1. If at the time of the conclusion of the contract you had your residence or habitual abode in Romania and have either moved out of Romania at the time of the lawsuit filed by us or your residence or habitual abode at this time is unknown, the place of jurisdiction for all disputes is the seat of our company.
